# Glimmer Acceptable Use Policy

## 1. Purpose

This Acceptable Use Policy explains what is and is not allowed when you use Glimmer. It applies to prompts, uploaded images, subject references, workflow notes, caption drafts, templates, saved works, feedback, account activity, generation requests, and any other content or behavior connected to Glimmer.

Glimmer is built for lawful, consent-based social-post planning and AI-assisted image generation. It is not a tool for evading safety systems, producing exploitative content, copying people without permission, or marketing unsafe AI output.

## 2. Operator

Glimmer is operated by MARQUE & CROWN INC., an Ontario company. Questions about this policy can be sent to support@glimmers.cc.

## 3. Relationship To Other Legal Documents

This policy is part of the Glimmer legal set. It should be read with the Glimmer Terms of Service, Privacy Policy, and Consent Notice for the active policy version. If this policy is stricter than a product screen, help text, prompt suggestion, template, or workflow example, this policy controls.

If a provider policy, payment rule, hosting rule, social-platform rule, or applicable law is stricter than this policy, the stricter requirement applies. Glimmer may refuse or restrict content even when a third-party provider has not separately blocked it.

## 4. Consent-Based Image Use

You may only upload, reference, transform, or generate from images when you have the rights and consent needed for the use. This includes selfies, portraits, client photos, brand assets, travel photos, private locations, wardrobe references, product images, screenshots, and any image showing another person.

Do not upload another person's image, a child's image, a private photo, a client asset, a confidential file, a location-revealing image, or third-party intellectual property unless you have clear permission for AI-assisted generation and any intended publication. You are responsible for releases, model permissions, location permissions, platform permissions, publicity rights, and intellectual-property clearance.

## 5. Sexual And Adult Content

NSFW, adult, pornographic, sexually explicit, sexually suggestive, fetish, sexual-service, or nudity-focused content is prohibited. You may not request, upload, edit, generate, save, publish, advertise, or attempt to bypass filters for sexual content.

This prohibition includes sexualized images of real people, non-consensual intimate imagery, sexual exploitation, sexual coercion, sexual content involving minors, and content that tries to present the service as suitable for adult image generation. Do not use coded terms, indirect prompt language, cropped images, suggestive styling, or workflow notes to evade this rule.

## 6. Face-Swap, Deepfake, And Face Manipulation

Glimmer prohibits face-swap, deepfake, deceptive likeness transfer, non-consensual face editing, and face manipulation that could make a person appear to say, do, wear, endorse, or participate in something they did not consent to.

You may not use Glimmer to impersonate another person, fabricate an endorsement, alter a person's identity in a misleading way, create fake evidence, simulate private or intimate activity, or generate a realistic likeness of a public figure, private person, client, employee, creator, child, or other individual without appropriate authority and consent.

## 7. Harmful, Illegal, Or Abusive Uses

You may not use Glimmer for harmful, illegal, abusive, deceptive, or exploitative activity. Prohibited uses include harassment, threats, defamation, discrimination, hate, exploitation, self-harm encouragement, violence, malware, spam, scams, fraud, illegal advertising, evasion of platform rules, fake identity documents, surveillance, biometric identification, unauthorized scraping, or attempts to overload or reverse engineer Glimmer.

You may not use Glimmer to generate instructions, imagery, captions, or workflow advice that meaningfully facilitates wrongdoing, unsafe behavior, regulated illegal activity, or harm to a person, group, service, provider, platform, or public process.

## 8. OpenAI API And Provider Rules

Glimmer may route generation requests, uploaded references, prompts, and related parameters to OpenAI API image generation and editing capabilities so that a user-requested workflow can run. OpenAI may apply its own safety systems, data controls, acceptable-use rules, rate limits, and temporary processing.

You must not use Glimmer to bypass a provider rule or to obtain output that a provider, safety system, law, platform, or this policy would reject. If provider rules are updated, Glimmer may update enforcement, block previously allowed workflows, or request changes to your content.

## 9. Moderation And Safety Screening

Before prompt-based image generation or reference-asset generation proceeds, Glimmer may rely on provider safety systems, product rules, local blocklists, manual review, account-level enforcement, and reporting workflows.

Moderation can flag, deny, block, remove, restrict, rate-limit, or escalate content, generation requests, templates, workflows, accounts, or outputs. A request that passes one check may still be blocked by another check. A request that is blocked by Glimmer may not be retried by changing spelling, using euphemisms, splitting text across fields, or hiding intent in an uploaded image.

## 10. Fail-Closed Enforcement

Glimmer uses a fail closed approach for safety-critical generation paths. If required moderation, provider checks, account checks, payment checks, consent checks, or policy checks cannot complete reliably, Glimmer may deny the request instead of allowing generation by default.

Fail closed means the system may refuse a request because a safety dependency is unavailable, unclear, or inconclusive. This may feel conservative, but it protects users, providers, payment partners, and MARQUE & CROWN INC. from preventable legal, safety, and compliance risk.

## 11. Marketing And Product Claims

You may not market Glimmer, your workflows, your prompts, your outputs, or derivative services as uncensored, no filter, unfiltered, adult-friendly, NSFW-friendly, deepfake-friendly, or designed to bypass moderation. You may not imply that Glimmer has no safety review or that prohibited content can be obtained with prompt tricks.

If you describe Glimmer-generated work publicly, do not falsely claim that a third-party provider created, approved, sponsored, endorsed, or guaranteed the content. Do not use provider logos, model names, payment-provider names, or platform names in a way that suggests affiliation or endorsement.

## 12. Public Templates, Workflows, And Community Content

Public templates and shared workflows must be suitable for general audiences and must not contain private photos, confidential information, personal data, illegal instructions, sexual prompts, hidden bypass instructions, harassment, impersonation instructions, or third-party content you cannot share.

MARQUE & CROWN INC. may review, edit, remove, reject, limit distribution of, or convert a public template into a private draft when it creates quality, policy, legal, provider, platform, or operational risk.

## 13. Account, Payment, And Abuse Controls

You may not create multiple accounts to evade bans, quotas, Spark limits, payment rules, moderation blocks, invite limits, or safety restrictions. You may not sell access to Glimmer, resell Sparks, automate requests without permission, share account credentials, use stolen payment methods, or abuse refunds.

Glimmer may preserve audit records needed to investigate abuse, enforce this policy, resolve disputes, process payments, handle taxes, prevent fraud, comply with law, or protect service security.

## 14. Output Review And Publication Responsibility

Generated images, captions, titles, hashtags, workflow explanations, and publishing advice are AI-assisted. You are responsible for reviewing output before saving, publishing, sharing, advertising, or selling it.

Your review should consider consent, likeness, identity, privacy, publicity rights, intellectual property, trademarks, regulated products, advertising disclosures, platform rules, cultural context, local law, and brand safety. A generated output appearing in your account does not mean it is lawful, safe, platform-compliant, or approved for publication.

## 15. Reporting And Contact

If you believe Glimmer is being misused, if an output involves your image or rights without permission, or if you need to report a policy issue, contact support@glimmers.cc. Include enough information for us to understand the request, such as account email, workflow name, approximate time, prompt or output identifiers if available, and the reason for your report.

We may ask for additional information before acting on a report. We may remove or restrict content while we review a report.

## 16. Consequences Of Violation

If you violate this policy, MARQUE & CROWN INC. may warn you, deny a request, block generation, remove content, restrict features, suspend or terminate your account, withhold or revoke template distribution, preserve evidence, refuse refunds where allowed, or report activity to providers, payment partners, platforms, or authorities when appropriate.

Repeated attempts to bypass moderation, including requests for NSFW, adult, sexually explicit, harmful, face-swap, deepfake, face manipulation, uncensored, no filter, or unfiltered output, may result in immediate account restriction.

## 17. Changes

MARQUE & CROWN INC. may update this Acceptable Use Policy as Glimmer changes, OpenAI API capabilities change, provider rules change, payment or moderation requirements change, or legal requirements evolve. Material updates may be shown in the app, by email, or through another reasonable notice.

Continued use of Glimmer after an updated policy takes effect means you accept the updated policy where permitted by law.
